These Terms & Conditions (“Terms”) outline the rules, expectations, and legal terms that apply to your use of kristinpalkonerphotography.com (the “Website”) and any photography services provided by Kristin Palkoner Photography (“Company,” “we,” “us,” or “our”). By using this Website, submitting an inquiry, booking a session, purchasing products or services, or otherwise engaging with Kristin Palkoner Photography, you agree to these Terms. If you do not agree, please do not use the Website or our services.
Agreement to Terms
By accessing this Website or booking a photography session, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, along with any related policies posted on the Website, including our Privacy Policy and Website Disclaimer. These Terms apply to all visitors, users, inquiry leads, and clients.
Services
Kristin Palkoner Photography provides photography services, which may include family photography, children’s photography, maternity photography, newborn photography, couples sessions, portrait sessions, and related products or offerings. All services are subject to availability and may be modified, updated, or discontinued at any time without notice.
Booking and Payment
A session is not considered officially booked until any required agreement has been completed and any required retainer, deposit, or session fee has been paid. Unless otherwise stated in writing, all retainers or deposits are non-refundable and are required to reserve your date on our calendar.
The remaining balance, if any, is due according to the payment schedule outlined at the time of booking or in your client agreement. We reserve the right to cancel, postpone, or withhold services, galleries, products, or image delivery if payments are not made on time. Pricing is subject to change at any time, but the pricing in effect at the time of booking will be honored for that booked session unless otherwise stated.
Cancellations and Rescheduling
If you need to cancel or reschedule a session, please notify us as soon as possible. Any cancellation, rescheduling, or transfer of session fees will be handled in accordance with the terms of your specific client agreement. Unless otherwise stated in writing, retainers or deposits are non-refundable because they reserve time on our calendar and may prevent us from accepting other bookings.
If a session must be rescheduled due to weather, illness, emergency, safety concerns, location restrictions, or circumstances beyond our control, we will make reasonable efforts to reschedule for a mutually agreeable date. We reserve the right to reschedule or cancel a session if conditions would make the session unsafe, impractical, or inconsistent with the quality of service we aim to provide.
Client Cooperation and Session Conditions
Clients are responsible for arriving on time, preparing participants for the session, and ensuring that children are supervised at all times. We will guide the session and provide direction as appropriate, but we cannot guarantee specific poses, expressions, cooperation from children, or exact outcomes. Photography sessions, especially those involving children and families, naturally vary based on mood, timing, weather, lighting, location conditions, and participant cooperation.
Clients are also responsible for disclosing any relevant location rules, permit requirements, restrictions, or safety concerns if a session is held on private property or at a client-selected location.
Image Delivery and Artistic Discretion
All images are edited in Kristin Palkoner Photography’s professional style and artistic discretion. By booking, you acknowledge that you are familiar with our portfolio and that final images will reflect our creative judgment, including decisions related to composition, lighting, posing, culling, and editing.
We reserve the right to select which images are delivered to the client. Unedited RAW files are not included unless specifically agreed to in writing. Delivery timelines are estimates unless otherwise stated and may vary depending on workload, season, or unforeseen circumstances.
Copyright and Personal Use
All photographs and content created by Kristin Palkoner Photography are protected by copyright law. Kristin Palkoner Photography retains the full copyright and ownership of all images unless otherwise agreed to in writing.
Clients are granted a limited, non-exclusive, non-transferable personal-use license to download, print, and share delivered images for personal, non-commercial use. This includes personal printing, sharing with family and friends, and posting on personal social media accounts, provided that the images are not altered beyond standard cropping permitted by the platform and that any watermark or branding is not removed if present.
Images may not be sold, submitted to vendors or publications, entered into contests, used for advertising, used in connection with a business, or otherwise used for commercial purposes without prior written permission. Commercial use, promotional use, or publication licensing requires separate written consent and may involve additional fees.
Image Alteration
Clients may not significantly edit, alter, manipulate, or apply filters to delivered images in a way that changes the look, quality, or artistic integrity of the work without prior written permission. This includes heavy retouching, color changes, overlaying graphics, or using third-party editing apps or filters. We want the images you share to reflect the quality and style of the final work delivered.
Model Release and Promotional Use
Unless otherwise agreed in writing, Kristin Palkoner Photography may use images from sessions for portfolio display, website content, social media, studio samples, marketing materials, competitions, publication submissions, educational content, or other lawful promotional purposes.
If you prefer that your images not be used for these purposes, you must notify us in writing before your session or sign any applicable privacy or no-promotion addendum offered by Kristin Palkoner Photography. We will always strive to honor written privacy requests that are agreed to in advance, but such requests may affect pricing, availability, or package terms if a private-session option is offered.
Client Representations
By booking a session, you confirm that you are at least 18 years old or are the parent or legal guardian of any minor participating in the session, and that you have authority to enter into this agreement on behalf of all participating parties. You also represent that any information you provide to us is accurate and complete.
Website Use
You agree to use this Website only for lawful purposes. You may not use the Website in any way that could damage, disable, overburden, or impair the Website or interfere with another person’s use of the Website. You may not attempt to gain unauthorized access to any portion of the Website, any server on which it is stored, or any systems connected to it.

In any event, our liability shall be limited to the amount actually paid by the client for the affected services, to the extent permitted by applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless Kristin Palkoner Photography from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your breach of these Terms, your misuse of the Website, your violation of any law, or your participation in a session, except to the extent caused by our gross negligence or willful misconduct.
